MARICOPA COUNTY CLERK’S OFFICE: ARIZONA SUPREME COURT – RULE 28 PETITION INFORMATION

Rule 28 of the Rules of the Supreme Court sets forth the procedures for the adoption, amendment, and abrogation of court rules. Petitions about local court rules are government by Rule 28.1.

Rule 28 provides that petitions filed by January 10 will be considered at the Court’s annual rules agenda held this summer. The deadline to file comments to the petitions is set forth by Supreme Court Order, and for those petitions that will be considered by the Supreme Court at is annual summer rules agenda, comments are due by May 1, 2025.

Anyone may file a comment to a petition, and comments are to be filed electronically on the Supreme Court’s Rules Forum or submitted via mail, with the preferred method being electronic submission. To view all of the petitions filed prior to the January 10, 2025 deadline, please visit https://www.azcourts.gov/Rules-Forum. The pending petitions are categorized by rule set (i.e., Rules of Civil Procedure, Rules of Criminal Procedure, etc.). The Court will consider all comments that are timely filed, approved, and posted to the Rules Forum in deciding whether to adopt, modify or reject a proposed new rule or an amendment to an existing rule.
